Agree­ment to Terms

BY ACCESS­ING OR USING THE ALL COV­ERED PAINT­ING & PROP­ER­TY SER­VICES LLC WEB­SITE (“WEB­SITE”), YOU AGREE TO BE BOUND BY THESE TERMS AND CON­DI­TIONS (“TERMS”) AND ALL TERMS INCOR­PO­RAT­ED BY REF­ER­ENCE. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRE­TY, DO NOT USE OUR WEBSITE.

We may sup­ply dif­fer­ent or addi­tion­al terms and con­di­tions in rela­tion to some of the ser­vices we pro­vide to you, includ­ing ser­vice agree­ments and esti­mates. These Terms do not alter in any way the terms or con­di­tions of any oth­er writ­ten agree­ment you may have with All Cov­ered Paint­ing & Prop­er­ty Ser­vices LLC (“All Cov­ered Paint­ing,” ​“we,” ​“us,” or ​“our”). If there is a con­flict between these Terms and any oth­er such writ­ten agree­ment, the oth­er writ­ten agree­ment will con­trol for that conflict.

We may make changes to these Terms from time to time. If we make changes, we will pro­vide you with notice of such changes, such as by send­ing an email, pro­vid­ing a notice through our Web­site, or updat­ing the date at the top of these Terms. Unless we say oth­er­wise in our notice, the amend­ed Terms will be effec­tive imme­di­ate­ly, and your con­tin­ued use of our Web­site after we pro­vide such notice will con­firm your accep­tance of the changes.

1. Eli­gi­bil­i­ty

The Web­site is not tar­get­ed towards, nor intend­ed for use by, any­one under the age of 18. You must be at least 18 years of age to use our Web­site and sub­mit requests for esti­mates or ser­vices. If you are under 18 years of age, you may use our Web­site only under the super­vi­sion of a par­ent or legal guardian who agrees to be bound by these Terms.

If you use our Web­site on behalf of anoth­er per­son or enti­ty, (a) all ref­er­ences to ​“you” through­out these Terms will include that per­son or enti­ty, (b) you rep­re­sent that you are autho­rized to accept these Terms on that per­son­’s or enti­ty’s behalf, and © in the event you or the per­son or enti­ty vio­lates these Terms, the per­son or enti­ty agrees to be respon­si­ble to us.

2. Ser­vices

All Cov­ered Paint­ing & Prop­er­ty Ser­vices LLC pro­vides pro­fes­sion­al paint­ing and prop­er­ty ser­vices in the Seat­tle, Wash­ing­ton area, includ­ing but not lim­it­ed to:

• Res­i­den­tial inte­ri­or and exte­ri­or painting
• Com­mer­cial paint­ing services
• Pres­sure wash­ing and exte­ri­or cleaning
• Gut­ter cleaning
• Hol­i­day light­ing instal­la­tion and removal
• Oth­er prop­er­ty main­te­nance ser­vices as offered

Online Esti­mate Sched­ul­ing: Our Web­site allows you to sched­ule esti­mate appoint­ments online. By sub­mit­ting an esti­mate request:

• You autho­rize us to con­tact you via phone, email, or text mes­sage regard­ing your project
• You con­firm that the infor­ma­tion pro­vid­ed is accu­rate and that you have author­i­ty to request ser­vices for the prop­er­ty in question
• You under­stand that an online esti­mate request is not a con­tract for ser­vices and does not oblig­ate either par­ty to pro­ceed with work

Esti­mates are Not Guar­an­tees: All esti­mates pro­vid­ed are approx­i­mate and sub­ject to change based on actu­al con­di­tions dis­cov­ered dur­ing the project. Final pric­ing will be detailed in a writ­ten ser­vice agree­ment before work begins.

3. Pro­hib­it­ed Con­duct and Content

You will not vio­late any applic­a­ble law, con­tract, intel­lec­tu­al prop­er­ty right, or oth­er third-par­ty right or com­mit a tort, and you are sole­ly respon­si­ble for your con­duct while using our Web­site. You will not:

• Engage in any harass­ing, threat­en­ing, intim­i­dat­ing, preda­to­ry, or stalk­ing conduct
• Use our Web­site for any fraud­u­lent or unlaw­ful purpose
• Sub­mit false, mis­lead­ing, or inac­cu­rate infor­ma­tion through our con­tact forms or esti­mate requests
• Attempt to imper­son­ate anoth­er per­son or entity
• Copy, repro­duce, dis­trib­ute, pub­licly per­form, or pub­licly dis­play all or por­tions of our Web­site, except as express­ly per­mit­ted by us or our licensors
• Mod­i­fy our Web­site, remove any pro­pri­etary rights notices or mark­ings, or oth­er­wise make any deriv­a­tive works based upon our Website
• Use our Web­site oth­er than for its intend­ed pur­pose and in any man­ner that could inter­fere with, dis­rupt, neg­a­tive­ly affect, or inhib­it oth­er users from ful­ly enjoy­ing our Web­site or that could dam­age, dis­able, over­bur­den, or impair the func­tion­ing of our Web­site in any manner
• Reverse engi­neer any aspect of our Web­site or do any­thing that might dis­cov­er source code or bypass or cir­cum­vent mea­sures employed to pre­vent or lim­it access to any part of our Website
• Use any data min­ing, robots, or sim­i­lar data gath­er­ing or extrac­tion meth­ods designed to scrape or extract data from our Website
• Devel­op or use any appli­ca­tions that inter­act with our Web­site with­out our pri­or writ­ten consent
• Send, dis­trib­ute, or post spam, unso­licit­ed or bulk com­mer­cial elec­tron­ic com­mu­ni­ca­tions, chain let­ters, or pyra­mid schemes
• Bypass or ignore instruc­tions con­tained in our robots.txt file
• Use our Web­site for any ille­gal or unau­tho­rized pur­pose, or engage in, encour­age, or pro­mote any activ­i­ty that vio­lates these Terms

4. User-Sub­mit­ted Content

When you sub­mit infor­ma­tion to us through our Web­site, includ­ing esti­mate requests, con­tact forms, pho­tos, project descrip­tions, or oth­er mate­ri­als (col­lec­tive­ly, ​“User Con­tent”), you grant us the fol­low­ing rights:

License to Use: You grant All Cov­ered Paint­ing a non-exclu­sive, world­wide, roy­al­ty-free, per­pet­u­al license to use, repro­duce, mod­i­fy, adapt, pub­lish, and dis­play your User Con­tent for the pur­pos­es of:

• Pro­vid­ing esti­mates and ser­vices to you
• Inter­nal busi­ness oper­a­tions and record-keeping
• Mar­ket­ing and pro­mo­tion­al pur­pos­es (with your consent)
• Qual­i­ty con­trol and train­ing purposes

Pho­tos and Project Doc­u­men­ta­tion: If you upload pho­tos of your prop­er­ty or project, you rep­re­sent and war­rant that:

• You own the prop­er­ty or have per­mis­sion from the prop­er­ty own­er to share the images
• The pho­tos do not vio­late any third-par­ty rights
• You con­sent to our use of the pho­tos for the pur­pos­es stat­ed above

Mar­ket­ing Use: We may request per­mis­sion to use before-and-after pho­tos of com­plet­ed projects for mar­ket­ing pur­pos­es. We will obtain your explic­it con­sent before using any pho­tos pub­licly. You may revoke this con­sent at any time by con­tact­ing us at office@​allcoveredpainting.​com.

Your Rep­re­sen­ta­tions: By sub­mit­ting User Con­tent, you rep­re­sent and war­rant that:

• You have all nec­es­sary rights to sub­mit the content
• The con­tent is accu­rate and not misleading
• The con­tent does not vio­late any applic­a­ble law or regulation
• The con­tent does not infringe upon any third-par­ty rights

5. Own­er­ship & Lim­it­ed License

The Web­site, includ­ing the text, graph­ics, images, pho­tographs, videos, illus­tra­tions, logos, and oth­er con­tent con­tained there­in, are owned by All Cov­ered Paint­ing or our licen­sors and are pro­tect­ed under both Unit­ed States and for­eign laws. Except as explic­it­ly stat­ed in these Terms, all rights in and to the Web­site are reserved by us or our licensors.

Sub­ject to your com­pli­ance with these Terms, you are here­by grant­ed a lim­it­ed, nonex­clu­sive, non­trans­fer­able, non-sub­li­cens­able, revo­ca­ble license to access and use our Web­site for your own per­son­al, non­com­mer­cial use. Any use of the Web­site oth­er than as specif­i­cal­ly autho­rized here­in, with­out our pri­or writ­ten per­mis­sion, is strict­ly pro­hib­it­ed, will ter­mi­nate the license grant­ed here­in and vio­late our intel­lec­tu­al prop­er­ty rights.

“All Cov­ered Paint­ing & Prop­er­ty Ser­vices,” ​“All Cov­ered Paint­ing,” our logos, our ser­vice names, our slo­gans (includ­ing ​“Where we make your home sparkle, shine, and glow all year!”), and the look and feel of the Web­site are trade­marks of All Cov­ered Paint­ing & Prop­er­ty Ser­vices LLC and may not be copied, imi­tat­ed, or used, in whole or in part, with­out our pri­or writ­ten permission.

All oth­er trade­marks, reg­is­tered trade­marks, prod­uct names, and com­pa­ny names or logos men­tioned on the Web­site are the prop­er­ty of their respec­tive own­ers. Ref­er­ence to any prod­ucts, ser­vices, process­es, or oth­er infor­ma­tion by trade name, trade­mark, man­u­fac­tur­er, sup­pli­er, or oth­er­wise does not con­sti­tute or imply endorse­ment, spon­sor­ship, or rec­om­men­da­tion by us.

• Respons­es to your inquiries
• Ser­vice reminders and follow-ups

Opt-Out: You may opt out of receiv­ing text mes­sages at any time by:

Mes­sage and Data Rates: Stan­dard mes­sage and data rates may apply based on your mobile car­ri­er’s plan. All Cov­ered Paint­ing is not respon­si­ble for any charges incurred from your mobile carrier.

Secu­ri­ty: Mobile phone infor­ma­tion is stored secure­ly and will not be shared with third par­ties or affil­i­ates for mar­ket­ing or pro­mo­tion­al pur­pos­es out­side of All Cov­ered Painting.

9. Third-Par­ty Con­tent and Links

We may pro­vide links to and infor­ma­tion about third-par­ty prod­ucts, web­sites, ser­vices, activ­i­ties, or events, or we may allow third par­ties to make their con­tent and infor­ma­tion avail­able on or through the Web­site (col­lec­tive­ly, ​“Third-Par­ty Con­tent”). We pro­vide Third-Par­ty Con­tent as a ser­vice to those inter­est­ed in such content.

Your deal­ings or cor­re­spon­dence with third par­ties and your use of or inter­ac­tion with any Third-Par­ty Con­tent are sole­ly between you and the third par­ty. All Cov­ered Paint­ing does not con­trol or endorse, and makes no rep­re­sen­ta­tions or war­ranties regard­ing, any Third-Par­ty Con­tent, and your access to and use of such Third-Par­ty Con­tent is at your own risk.

10. Ser­vice-Relat­ed Responsibilities

Prop­er­ty Access: When sched­ul­ing ser­vices, you agree to:

• Pro­vide safe and rea­son­able access to the work areas
• Dis­close any known haz­ards or spe­cial con­di­tions (lead paint, asbestos, struc­tur­al issues, etc.)
• Ensure that pets are secured and will not inter­fere with work
• Move or pro­tect valu­able items, fur­ni­ture, and belong­ings as rea­son­ably necessary
• Main­tain clear com­mu­ni­ca­tion regard­ing access and scheduling

Prop­er­ty Own­er Autho­riza­tion: If you are not the prop­er­ty own­er, you rep­re­sent and war­rant that you have autho­riza­tion from the prop­er­ty own­er to request esti­mates and poten­tial­ly autho­rize work on the property.

Accu­ra­cy of Infor­ma­tion: You agree to pro­vide accu­rate infor­ma­tion about your prop­er­ty, project scope, and con­tact details. Inac­cu­rate infor­ma­tion may result in revised esti­mates or project delays.

Changes to Scope: Any changes to the agreed-upon scope of work must be doc­u­ment­ed in writ­ing and may result in adjust­ed pric­ing and time­lines. Ver­bal change orders must be con­firmed in writ­ing to be valid.

11. Lim­i­ta­tion of Warranty

Web­site ​“As Is”: The Web­site and all infor­ma­tion con­tained there­in are pro­vid­ed ​“as is” and ​“as avail­able” with­out war­ranties of any kind, either express or implied, includ­ing, but not lim­it­ed to, implied war­ranties of mer­chantabil­i­ty, fit­ness for a par­tic­u­lar pur­pose, title, and non-infringement.

No Guar­an­tee of Avail­abil­i­ty: All Cov­ered Paint­ing does not rep­re­sent or war­rant that our Web­site is accu­rate, com­plete, reli­able, cur­rent, or error-free. We do not guar­an­tee that the Web­site will be avail­able at all times or that it will be free of virus­es or oth­er harm­ful components.

Esti­mates are Approx­i­ma­tions: Esti­mates pro­vid­ed through the Web­site or dur­ing on-site vis­its are approx­i­ma­tions based on avail­able infor­ma­tion. Final pric­ing may vary based on actu­al con­di­tions, unfore­seen com­pli­ca­tions, or changes to project scope.

Ser­vice War­ranties: War­ranties relat­ed to the actu­al paint­ing and prop­er­ty ser­vices we pro­vide are gov­erned by sep­a­rate writ­ten ser­vice agree­ments, not by these Web­site Terms and Con­di­tions. These ser­vice war­ranties are typ­i­cal­ly pro­vid­ed in writ­ing at the time of con­tract­ing and may vary based on the spe­cif­ic ser­vices provided.

12. Lim­i­ta­tion of Liability

Web­site Use: To the fullest extent per­mit­ted by applic­a­ble law, All Cov­ered Paint­ing and its offi­cers, direc­tors, employ­ees, agents, and affil­i­ates (col­lec­tive­ly, ​“All Cov­ered Par­ties”) will not be liable to you under any the­o­ry of lia­bil­i­ty — whether based in con­tract, tort, neg­li­gence, strict lia­bil­i­ty, war­ran­ty, or oth­er­wise — for any indi­rect, con­se­quen­tial, exem­plary, inci­den­tal, puni­tive or spe­cial dam­ages or lost prof­its aris­ing from your use of the Web­site, even if All Cov­ered Par­ties have been advised of the pos­si­bil­i­ty of such damages.

Total Lia­bil­i­ty Cap: The total lia­bil­i­ty of All Cov­ered Par­ties for any claim aris­ing out of or relat­ing to these Terms or our Web­site, regard­less of the form of the action, is lim­it­ed to $500.

Ser­vice-Relat­ed Claims: Lia­bil­i­ty relat­ed to actu­al paint­ing and prop­er­ty ser­vices per­formed is gov­erned by sep­a­rate writ­ten ser­vice agree­ments and is not lim­it­ed by these Web­site Terms and Con­di­tions. Claims relat­ed to prop­er­ty dam­age, work­man­ship, or ser­vice qual­i­ty should be direct­ed to office@​allcoveredpainting.​com or (206) 682‑7110.

Excep­tions: The lim­i­ta­tions set forth in this sec­tion will not lim­it or exclude lia­bil­i­ty for the gross neg­li­gence, fraud, or inten­tion­al mis­con­duct of All Cov­ered Par­ties or for any oth­er mat­ters in which lia­bil­i­ty can­not be exclud­ed or lim­it­ed under applic­a­ble law. Addi­tion­al­ly, some juris­dic­tions do not allow the exclu­sion or lim­i­ta­tion of inci­den­tal or con­se­quen­tial dam­ages, so the above lim­i­ta­tions or exclu­sions may not apply to you.

13. Indem­ni­fi­ca­tion

To the fullest extent per­mit­ted by applic­a­ble law, you will indem­ni­fy, defend, and hold harm­less All Cov­ered Par­ties from and against any loss­es, lia­bil­i­ties, claims, demands, dam­ages, expens­es, or costs (“Claims”) aris­ing out of or relat­ed to:

• Your access to or use of the Website
• Your User Con­tent or any infor­ma­tion you sub­mit through the Website
• Your vio­la­tion of these Terms
• Your vio­la­tion, mis­ap­pro­pri­a­tion, or infringe­ment of any rights of anoth­er (includ­ing intel­lec­tu­al prop­er­ty rights or pri­va­cy rights)
• Your con­duct in con­nec­tion with the Website
• Any false, mis­lead­ing, or inac­cu­rate infor­ma­tion you provide

You agree to prompt­ly noti­fy All Cov­ered Par­ties of any third-par­ty Claims, coop­er­ate with All Cov­ered Par­ties in defend­ing such Claims and pay all fees, costs, and expens­es asso­ci­at­ed with defend­ing such Claims (includ­ing, but not lim­it­ed to, attor­neys’ fees). You also agree that All Cov­ered Par­ties will have con­trol of the defense or set­tle­ment, at our sole option, of any third-par­ty Claims.

14. Gov­ern­ing Law and Venue

These Terms and any dis­pute aris­ing out of or relat­ed to these Terms or the Web­site will be gov­erned by the laws of the State of Wash­ing­ton, with­out regard to its con­flict of laws prin­ci­ples. Any legal action or pro­ceed­ing aris­ing under these Terms will be brought exclu­sive­ly in the fed­er­al or state courts locat­ed in King Coun­ty, Wash­ing­ton, and the par­ties irrev­o­ca­bly con­sent to the per­son­al juris­dic­tion and venue therein.

15. Dis­pute Resolution

Infor­mal Res­o­lu­tion: Before fil­ing any for­mal legal action, you agree to first con­tact us at office@​allcoveredpainting.​com to attempt to resolve any dis­pute infor­mal­ly. We will attempt to resolve the dis­pute infor­mal­ly by con­tact­ing you via email or phone.

Small Claims Court: Either par­ty may bring an indi­vid­ual action in small claims court in King Coun­ty, Wash­ing­ton, rather than through arbi­tra­tion or oth­er for­mal pro­ceed­ings, pro­vid­ed the claim qual­i­fies for small claims court jurisdiction.

Ser­vice-Relat­ed Dis­putes: Dis­putes relat­ed to the qual­i­ty of paint­ing or prop­er­ty ser­vices per­formed, pric­ing dis­putes, or war­ran­ty claims should be addressed through the dis­pute res­o­lu­tion process out­lined in your writ­ten ser­vice agree­ment (if applic­a­ble) or by con­tact­ing us direct­ly at office@​allcoveredpainting.​com or (206) 682‑7110.

16. Elec­tron­ic Communications

You agree that all agree­ments, notices, dis­clo­sures, and oth­er com­mu­ni­ca­tions that we pro­vide to you elec­tron­i­cal­ly sat­is­fy any legal require­ment that such com­mu­ni­ca­tions be in writ­ing. By using the Web­site and pro­vid­ing your email address or phone num­ber, you con­sent to receive elec­tron­ic com­mu­ni­ca­tions from us, including:

• Respons­es to your esti­mate requests and inquiries
• Ser­vice-relat­ed noti­fi­ca­tions and updates
• Mar­ket­ing and pro­mo­tion­al com­mu­ni­ca­tions (which you may opt out of)
• Admin­is­tra­tive mes­sages regard­ing your account or our services

17. Data Trans­fer and Processing

In order for us to pro­vide our Web­site and ser­vices, you agree that we may process, trans­fer, and store infor­ma­tion about you in the Unit­ed States. All Cov­ered Paint­ing takes rea­son­able mea­sures to pro­tect your per­son­al infor­ma­tion, but we can­not guar­an­tee absolute secu­ri­ty. Your use of the Web­site and pro­vi­sion of infor­ma­tion is at your own risk.

18. Mod­i­fy­ing and Ter­mi­nat­ing our Website

We reserve the right to mod­i­fy our Web­site or to sus­pend or stop pro­vid­ing all or por­tions of our Web­site at any time with­out notice. You also have the right to stop using our Web­site at any time. We are not respon­si­ble for any loss or harm relat­ed to your inabil­i­ty to access or use our Website.

We may also ter­mi­nate or sus­pend your access to our Web­site imme­di­ate­ly, with­out pri­or notice or lia­bil­i­ty, if you breach any of these Terms.

19. Sev­er­abil­i­ty

If any pro­vi­sion or part of a pro­vi­sion of these Terms is unlaw­ful, void, or unen­force­able, that pro­vi­sion or part of the pro­vi­sion is deemed sev­er­able from these Terms and does not affect the valid­i­ty and enforce­abil­i­ty of any remain­ing provisions.

20. Entire Agreement

These Terms, togeth­er with our Pri­va­cy Pol­i­cy and any writ­ten ser­vice agree­ments, con­sti­tute the entire agree­ment between you and All Cov­ered Paint­ing regard­ing your use of the Web­site and super­sede all pri­or and con­tem­po­ra­ne­ous under­stand­ings, agree­ments, rep­re­sen­ta­tions, and war­ranties, both writ­ten and oral, regard­ing the Website.

21. No Waiver

The fail­ure of All Cov­ered Paint­ing to exer­cise or enforce any right or pro­vi­sion of these Terms will not oper­ate as a waiv­er of such right or pro­vi­sion. No waiv­er by All Cov­ered Paint­ing of any term or con­di­tion set forth in these Terms shall be deemed a fur­ther or con­tin­u­ing waiv­er of such term or con­di­tion or a waiv­er of any oth­er term or condition.

22. Assign­ment

You may not assign or trans­fer these Terms or your rights under these Terms, in whole or in part, by oper­a­tion of law or oth­er­wise, with­out our pri­or writ­ten con­sent. We may assign these Terms at any time with­out notice to you.
